Guidelines for the officers designated as state public information officer under the Right to Information Act 2005

1.The particulars of GSHRC’s organization, functions and duties

The Gujarat State Human Rights Commission was set up in the year 2006 under the Protection of Human Rights Act, 1993. The GSHRC has the following constituent Divisions: -

(a.) Legal Wing: 

It deals with the matters relating to human rights violations, either on its own or on a request by a party, provides hearing to the parties in appropriate cases depending upon the facts and circumstances of each case.

The Legal wing consists of three branches as under.

1. Legal - 1 Branch:

  • It deals with the Criminal / Civil applications, custodial death and suo-moto cases relating to human rights violations, either on its own or on a request by a party.
  • It also deals with RTI application.

2. Legal - 2 Branch:

  • It deals with the Criminal / Civil applications, custodial death and suo-moto cases relating to human rights violations, either on its own or on a request by a party.

3.Legal - 3 Branch:

  • It deals with the Criminal / Civil applications, custodial death and suo-moto cases relating to human rights violations, either on its own or on a request by a party.
  • It also deals with RTI application.
  • It Prepares Annual Reports of the commission.
  • It co-ordinates with all branches and collect details regarding different matters
  • An important function is to create human rights awareness through print/electronic media, website and printing of various publications, advocacy materials etc.
  • It organizes internship of law students from different universities.
  • It also deals with the matters relating to NHRC and maintains library of the commission.

Investigation Wing:

Under section 14 A of the Protection of Human Rights Act, 1993 The Commission may utilize the service of any officer or Investigation agency of the State Government for the purpose of conducting any investigation pertaining to inquiry, as the case may be.

(b.)Administration Wing:

It deals with the overall management of General Administration, Establishment, Accounts, Coordination & Internal Issues.

It also deals with need of training in the different categories of officials and non-officials, institutions/ organizations etc. Networking with national/state level institutions (both Government/ Non-Government/ UN institutions) etc.

It also deals with the preparation of software programmes for the Commission.

The Administration wing consists of three branches as under.

1) Registry Branch:

  • It deals with Inward and outward of letters / Applications.
  • It also deals with distribution of letters / Applications according to their respective branches.

2) Account Branch:

  • It deals with salary and allowances of employees / officers
  • It also Deals with all kinds of bills, Budget Preparation and Grant Release.
  • It maintains cash book and service book of employees / Officers.
  • It deals with Income Tax, GST and TDS.

3) Establishment Branch:

  • It deals with service and discipline related matters of employee’s / Officers
  • It deals with purchase and maintenance of vehicles, electric / electronic equipment and stationary for the commission.
  • It also deals with RTI application.

2. The powers and duties of GSHRC’s officers and employees:

The Commission functions as per the powers given to it under the Protection of Human Rights Act, 1993.

3. Procedure followed in the decision making process, including channels of supervision and accountability:

4.The norms set by GSHRC’s for the discharge of its functions:

The complaints are dealt on priority basis as per date of receipt and efforts are made to deal with the cases as expeditiously as possible in accordance with the rules, regulations and other instructions issued from time to time.

5.The rules, regulations, instructions, manuals and records, held by GSHRC or under its control or used by its employees for discharge of its functions:

The Commission discharges its functions in accordance with the rules, regulations, instructions, manuals etc. issued by the Govt. of Gujarat and the Commission from time to time. And, also as per the mandate given to it under the Protection of Human Rights Act, 1993. They are the following:

6. A statement of the categories of documents that are held by GSHRC or under its control:

Details of all the publications of the Commission are available on the web site. The documents held by the Commission include relevant files on subjects dealt with in the Commission and service documents of its officials.

7. The particulars of any arrangement that exists for consultation with, or representation by the members of the public in relation to the formulation of GSHRC’s policy or implementation thereof

A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as GSHRC’s part or for the purpose of its advice, and as to whether meetings of those boards council’s committees and other bodies are open to the public or the minutes of such meeting are accessible for public.

The Commission has established an Internal complaint committee under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

10.The monthly remuneration received by each of GSHRC’s officers and employees, including the system of compensation as provided in its regulations.

The officers and the employees in GSHRC are being paid monthly remuneration in their respective scale of pay as mentioned in the GR (Para 5 (c) above)[Click Here]

There are no subsidy programmes being implemented by the State Commission.

Waiting rooms have been set up by the Gujarat State Human Rights Commission.
